Die Verarbeitung personenbezogener Daten ist ein notwendiger Bestandteil unserer Tätigkeit. Ohne die Übermittlung personenbezogener Daten und ihre Verarbeitung sind wir nicht imstande, Ihnen unsere Leistungen anzubieten, eine vertragliche Beziehung mit Ihnen einzugehen und die daraus resultierenden Verpflichtungen zu erfüllen. Sofern Ihre Einwilligung zur Verarbeitung von personenbezogenen Daten erforderlich ist, werden wir keineswegs die Zustimmung durch die Androhung der Ablehnung eines Vertragsabschlusses, der Leistungserbringung oder die uns festgelegten Verpflichtungen erzwingen.
Wir verarbeiten Ihre personenbezogenen Daten im Rahmen der allgemein geltenden gesetzlichen Vorschriften und stellen sicher, dass diese nicht unberechtigt verarbeitet oder missbraucht werden. Der Schutz personenbezogener Daten, der Privatsphäre und der Rechte jedes Einzelnen ist einer der Grundsätze, die unsere Mitarbeiter stets einhalten.
Unsere Mitarbeiter sind sich des Wertes und der Sensibilität der personenbezogenen Daten, mit denen sie in Kontakt kommen und mit denen sie arbeiten, bewusst. Sie sind sich auch der Schäden durch Offenlegung, Löschung oder Änderung solcher Daten des Datensubjekts, einschließlich Ihnen, bewusst.

Welche personenbezogenen Daten werden von uns verarbeitet?

Die persönlichen Daten, die Sie uns zur Verfügung stellen und die wir verarbeiten, dienen dem Vertragsabschluss und der Vertragserfüllung. Falls Sie mit der Gewährung zu diesem Zweck nicht einverstanden sind, kann der Vertrag nicht abgeschlossen werden. Zu diesem Zweck (Vertragserfüllung) werden Ihre im Vertrag angegebenen Identifikationsangaben bzw. Ihre Kontaktdaten sowie Angaben zum Vertragsgegenstand (z.B. Daten über Zahlungen für Produkte und Dienstleistungen, einschließlich der Informationen wie Bankkontonummer und andere Daten, die für die Vertragserfüllung erforderlich sind) nur im unbedingt notwendigen Umfang verarbeitet. Wir haben auch das Recht, diesen Umfang personenbezogener Daten zu verarbeiten, um unsere Rechte im Falle einer Streitigkeit mit Kunden zu schützen.

Die obigen personenbezogenen Daten, die Sie uns zur Verfügung stellen, werden auf folgender Rechtsgrundlage verarbeitet:

  Kauf und Verkauf von Waren und Dienstleistungen, Rechnungsstellung, gegenseitige Kommunikation
• Einhaltung gesetzlicher Verpflichtungen
  Verpflichtung gemäß tschechischem oder EU-Recht – z.B. Buchhaltungsgesetz, Bürgerliches Gesetzbuch, Versicherungsgesetz, Gesetz über Handelskorporationen, Geldwäschegesetz (GWG) usw.

Wem stellen wir Ihre personenbezogenen Daten zur Verfügung?

Wir geben Ihre personenbezogenen Daten nur im Rahmen unseres Unternehmens weiter. Ihre personenbezogenen Daten können im unbedingt notwendigen Umfang an Dritte übermittelt oder veröffentlicht werden. Es handelt sich um unten angeführte Empfänger, ggf. Verarbeiter:

• Unsere Logistik-Dienstleister (Lieferung von Waren und Dienstleistungen) – im Rahmen der Vertragserfüllung.
• Unsere Partner für die Registrierung, Werbung und Feedback-Einholung zur Verbesserung der an unsere Kunden gelieferten Waren und erbrachten Dienstleistungen – im Rahmen des berechtigten Interesses des Verwalters.
• Wirtschaftsprüfergesellschaften – im Rahmen der gesetzlichen Pflicht.
• IT-Unternehmen – auf der Grundlage des berechtigten Interesses des Verwalters. Es handelt sich um IT-Outsourcing und einen beiläufiger Zugriff auf die personenbezogenen Daten im Rahmen der Verwaltung von IT-Systemen.
• Organe der staatlichen Verwaltung – Finanzämter, Krankenkassen, Sozialversicherungsträger, Gerichte, Gerichtsvollzieher und dergleichen – auf der Grundlage der Erfüllung der gesetzlichen Pflichten.

Jedes Datensubjekt / jeder Dritte, dem wir Ihre personenbezogenen Daten zum oben genannten Zweck übermitteln (sofern es sich nicht um eine rechtliche Verpflichtung handelt), verpflichten wir vertraglich dazu, die personenbezogenen Daten zu schützen sowie die Verschwiegenheitspflicht und die Pflicht zur Zusammenarbeit bei der Überprüfung der Einhaltung von Bestimmungen der DSGVO einzuhalten.

Ihre Rechte

Das Unternehmen identifiziert sich mit den Grundsätzen der Verordnung 2016/679 des Europäischen Parlaments und des Rates zum Schutz natürlicher Personen bei der Verarbeitung personenbezogener Daten und des freien Datenverkehrs (DSGVO) und ist bereit, bei der Wahrnehmung Ihrer Rechte uneingeschränkt zusammenzuarbeiten.
Ihre Rechte gemäß DSGVO:

• Recht des Datensubjekts auf Löschung (Recht auf Vergessenwerden), (Artikel 17 DSGVO)
  Ihre personenbezogenen Daten werden gelöscht, mit Ausnahme der Daten, die zur Erfüllung einer gesetzlichen Verpflichtung, für die Verteidigung von Rechtsansprüchen oder für den Schutz öffentlicher Interessen erforderlich sind.
• Recht des Datensubjekts auf Einsichtnahme in die Daten, die dem Verwalter oder Verarbeiter zur Verfügung stehen (Artikel 15 DSGVO)
  Es wird Ihnen eine Kopie mit den personenbezogenen Daten, die wir im Zusammenhang mit Ihrer Person verarbeiten, übermittelt, mit Ausnahme unseres geistigen Eigentums oder unserer Geschäftsgeheimnisse, sowie Fälle, in denen die personenbezogenen Daten anderer Personen weitergegeben werden könnten.
• Recht des Datensubjekts auf das Einlegen eines Widerspruchs gegen die Verarbeitung von personenbezogenen Daten (Artikel 21 DSGVO)
  Sie können jederzeit einen Widerspruch, der entsprechend behandelt wird, um Ihre Interessen nicht zu beeinträchtigen, einlegen. Der Widerspruch kann in denjenigen Fällen geltend gemacht werden, in denen die Verarbeitung im Interesse des Verwalters oder Dritter erforderlich ist, oder er kann gegen die Verarbeitung von personenbezogenen Daten für Zwecke der Direktwerbung oder Profiling eingelegt werden. Sollten Sie einen Widerspruch gegen die Verarbeitung für Zwecke der Direktwerbung einlegen, werden Ihre personenbezogenen Daten für diese Zwecke nicht mehr verarbeitet.
• Recht des Datensubjekts auf Einschränkung der Verarbeitung (Artikel 18 DSGVO)
  Auf der Grundlage Ihres Widerspruchs wird die Verarbeitung Ihrer personenbezogenen Daten eingeschränkt. Die Verarbeitung personenbezogener Daten bleibt bis zur Prüfung eines eventuellen Widerspruchs eingeschränkt.
• Recht des Datensubjekts auf die Übertragbarkeit der personenbezogenen Daten vom Verwalter an Dritte (Artikel 20 DSGVO)
  Sofern Sie uns Ihre personenbezogenen Daten auf der Grundlage eines Vertrags oder einer Einwilligung zur Verfügung gestellt haben, werden Ihre personenbezogenen Daten in einem strukturierten, gängigen elektronischen Format übertragen, so dass Sie diese an Dritte weitergeben können.
• Recht des Datensubjekts bei automatisierten Entscheidungen eine physische Überprüfung zu verlangen (Artikel 22 DSGVO)
  Sollten Sie aufgrund der von Ihnen angegebenen personenbezogenen Daten Zweifel hinsichtlich der Genauigkeit des automatisierten Entscheidungsprozesses haben, stellen wir sicher, dass die Entscheidung mittels einer autorisierten Rolle getroffen wird.
• Recht des Datensubjekts auf die Aktualisierung personenbezogener Daten, um allfällige Beeinträchtigungen durch die veraltete Version zu verhindern (Artikel 16 DSGVO)
  Wir werden die Aktualisierung Ihrer personenbezogenen Daten auf der Grundlage Ihres Antrags sicherstellen.

Unser Unternehmen informiert Sie in Übereinstimmung mit Art. 21 Abs. 4 der Datenschutz-Grundverordnung insbesondere darüber, dass Sie das Recht haben, einen Widerspruch gegen die automatisierte Einzelentscheidungen einzulegen. Darüber hinaus haben Sie gemäß der Best. § 21 Abs. 2 das Recht, jederzeit einen Widerspruch gegen die Verarbeitung Ihrer personenbezogener Daten zum Zwecke der Direktwerbung einzulegen (siehe oben). Im Falle des Verdachts, dass Ihre personenbezogenen Daten unrechtmäßig verarbeitet werden, haben Sie das Recht, beim tschechischen Datenschutzamt eine Beschwerde einzureichen.

Organisatorische und technische Maßnahmen zum Schutz personenbezogener Daten

Unser Unternehmen gewährleistet den Schutz Ihrer personenbezogenen Daten mittels eines Sicherheitsmanagementsystems, das auf der Analyse von Risiken für personenbezogene Daten basiert. Wir versichern, dass wir die Sicherheitslage und -risiken kontinuierlich überprüfen und unsere Sicherheitspläne ändern, um eine Gefährdung Ihrer personenbezogener Daten zu vermeiden. Darüber hinaus versichern wir weiter, dass angemessene Vorgehensweisen und Technologien implementiert werden, um sowohl organisatorisch als auch technisch die Informationssicherheit sowie die physische, personelle und administrative Sicherheit zu gewährleisten. How we process your personal data

The personal data you provide to us and which we process is used to conclude and execute the contract. If you do not agree to provide your data for this purpose, you cannot conclude the contract. For this purpose (fulfillment of the subject matter of the agreement), only your identification data specified in the contract or your contact details will be processed to the necessary extent, as well as information relating to the subject matter of the contract (e.g. data on payments for products and services, including information such as the bank account number and other data necessary for the performance of the contract). We also have the right to process this range of personal information to protect our rights in the event of a dispute with a customer.

On what basis we process your personal data

The above personal information you provide to us is processed on the basis of the following legal basis:

• Performance or conclusion of the contract
  Purchase and sale of goods and services, invoicing, mutual communication
• Fulfilment of legal obligations
  Obligation under Czech law or EU law – such as the Act on Accounting, the Civil Code, the Act on Insurance, the Act on Commercial Corporations, the Act on the Legalization of Proceeds from Crime (AML)
• Legitimate interest
  Property protection (camera system), handing over within our company for administrative purposes, direct marketing.

To whom we provide your personal information

We only share your personal information within our company. Your personal data may be further provided and made available to third parties to the extent necessary. It concerns the following groups of recipients or processors:

• Our suppliers to provide logistics (delivery of goods and services) – as part of the performance of the contract.
• Our partners to secure registration, claims, and feedback to improve our products and services provided to our customers – within the legitimate interests of the administrator.
• Audit companies – in the framework of the performance of legal obligations.
• IT companies – based on the legitimate interest of the administrator. IT outsourcing services and random access to personal information within IT systems management.
• State administration bodies – tax offices, health insurance companies, social insurance companies, courts, court executors and the like – on the basis of legal obligations.
• Every entity / third party that we pass your personal data onto for the above purpose (unless it is the fulfillment of a legal obligation) is bound by a contract that includes, inter alia, the obligation to protect personal data, the confidentiality obligation and the duty of cooperation to check compliance with GDPR provisions.

Passing on your personal data abroad

We only transfer your personal information within our company and they are not transferred abroad.

How long we keep your personal information

We keep your personal information depending on the purpose for which we obtained it. We process your personal data for at least the duration of the contract, and then we are required to keep your personal data in accordance with the shredding deadlines set by the law.

Processing of cookies, IP address monitoring and other means of technological monitoring

We do not use any means to track, analyze, and evaluate cookies, IP addresses, and other electronic tags.

Profiling on the basis of personal data

We do not perform profiling based on the provided personal information.

Your rights

The company is committed to the principles established by European Parliament and Council Regulation 2016/679 on the protection of individuals with regard to the processing of personal data and the free movement of such data (GDPR) and is ready to fully cooperate in exercising your rights.
According to GDPR, your rights are:

• The right of the PD entity to the deletion of PD (right to be forgotten), (Article 17 GDPR)
  Your personal data will be erased except for the data necessary to fulfill a legal obligation, data necessary for the defense of legal claims or data necessary for the protection of public interests.
• The right of the PD entity to be acquainted with the data that the administrator or the processor has on the entity (Article 15 GDPR)
  you will be provided with a copy of the personal data we hold about you, except for our intellectual property or our business secret, as well as cases where the personal data of others may be transmitted.
• The right of the PD entity to object to the processing of personal data (Article 21 GDPR)
  you can raise an objection at any time, which will be dealt with in a way that will not harm your interests. The objection may be invoked in cases where processing is necessary for the purposes of the legitimate interests of the relevant administrator or third party, or against the processing of personal data for direct marketing or profiling purposes. If you oppose processing for direct marketing purposes, your personal data will no longer be processed for this purpose.
• The right of the PD entity to limit processing (Article 18 GDPR)
  on the basis of your objection, to limit the processing of your personal data. The processing of personal data is limited until the resolution of the objection.
  The right of the PD entity to transfer its personal data from the administrator to a third party (Article 20 GDPR)
  if you provided us with your personal data on the basis of a contract or consent, your personal data will be exported in a structured, commonly used electronic format so that you can transfer it to a third party.
• The right of the PD entity to request review by a person in the case of automated decision-making (Article 22 GDPR)
  If you are in doubt about the accuracy of automated decision-making on the basis of the personal data you provide, we will ensure the implementation of the decision by an authorized role.
• The right of the PD entity to the updating of personal data so that its outdated version does not cause harm (Article 16 GDPR)
  we will ensure that your personal data is updated based on your request.

In accordance with Article 21 (4) of the GDPR, our company notifies you in particular that you have the right to object to automated individual decision-making under Article 21 of the GDPR and that under Section 21 para. 2 of the GDPR you have the right at any time to object to the processing of personal data for direct marketing purposes (see above). If you suspect that your personal data is being processed unlawfully, you have the right to file a complaint with the Czech Republic’s Personal Data Protection Office.

Organisational and technical measures to protect personal data

Our company ensures the protection of your personal data by a security management system based on the analysis of personal data risks. We assure you that we continually assess the security situation and risks and modify our security plans to avoid compromising your personal data. We also want to make sure that adequate procedures and technologies are implemented to ensure informational, physical, personnel and administrative security, both through organizational and technical means. For understandable reasons, we do not mention these procedures and mechanisms at this point.

Zpracování osobních údajů je nezbytnou součástí naší činnosti. Společnost a každý zaměstnanec společnosti se osobně zavazují chránit důvěrnost, dostupnost a neporušenost osobních údajů, se kterými přichází do styku a se kterými pracují, protože to považují za věc své osobní profesní cti bez ohledu na to, jestli je k tomu zavazuje právní akt. Naši zaměstnanci Vaše osobní údaje nezveřejní, nikomu neoprávněně nepředají, nepozmění nebo nezničí a nebudou s nimi nakládat, s výjimkou rozsahu stanoveného náplní práce. Aby se naši zaměstnanci vyhnuli nezamýšlenému vyzrazení, zničení nebo pozměnění Vašich osobních údajů, pravidelně se v dané oblasti vzdělávají a absolvují pravidelná školení.

Jaké Vaše osobní údaje zpracováváme

Osobní údaje, které nám poskytujete a které my zpracováváme, slouží k uzavření smlouvy a k jejímu plnění. V případě, že s poskytnutím svých údajů za tímto účelem nesouhlasíte, nelze smlouvu uzavřít. Za tímto účelem (plnění předmětu smlouvy) budou v nezbytném rozsahu zpracovávány pouze Vaše identifikační údaje uvedené ve smlouvě, případně Vaše kontaktní údaje, a dále informace vztahující se k předmětu smlouvy (např. údaje o platbách za produkty a služby, včetně informací jako je číslo bankovního účtu a další údaje nezbytné pro plnění smlouvy). Tento rozsah osobních údajů jsme oprávněni zpracovávat také za účelem ochrany svých práv v případě sporu se zákazníkem.

Na jakém právním základu Vaše osobní údaje zpracováváme

Výše uvedené osobní údaje, které nám poskytujete, jsou zpracovány na základě níže uvedeného právního základu:

• Plnění či uzavření smlouvy
  • Nákup a prodej zboží a služeb, fakturace, vzájemná komunikace
• Plnění právní povinnosti
  • Povinnost dle českého práva nebo práva EU – např. Zákon o účetnictví, Občanský zákoník, Zákon o pojišťovnictví, Zákon o obchodních korporacích, Zákon o legalizaci výnosů z trestné činnosti (AML) atd.
• Oprávněný zájem
  • Ochrana majetku (kamerový systém), předávání v rámci naši společnosti pro administrativní účely, přímý marketing.

Komu Vaše osobní údaje poskytujeme

Vaše osobní údaje si předáváme pouze v rámci naši společnosti. Vaše osobní údaje mohou být dále v nezbytném rozsahu poskytnuty a zpřístupněny třetím stranám. Jde o níže uvedené okruhy příjemců, případně zpracovatelů:

• Naši dodavatelé pro zajištění logistiky (dodávka zboží a služeb) – v rámci plnění smlouvy.
• Naši partneři pro zajištění registrace, reklamace a získání zpětné vazby pro vylepšení zboží a služeb poskytovaných našim zákazníkům – v rámci oprávněných zájmů správce.
• Auditorské společnosti – v rámci plnění právní povinnosti.
• IT společnosti – na základě oprávněného zájmu správce. Jedná se o outsourcing IT služeb a případný nahodilý přístup k osobním údajům v rámci správy IT systémů.
• Orgány státní správy – daňové úřady, zdravotní pojišťovny, sociální pojišťovny, soudy, soudní exekutoři a podobně – na základě plnění právní povinnosti.

Každý subjekt/třetí stranu, které Vaše osobní údaje za výše uvedeným účelem předáváme (pokud se nejedná o plnění právní povinnosti), zavazujeme smlouvou, která mimo jiné ustanovuje povinnost chránit osobní údaje, povinnost mlčenlivosti a povinnost spolupráce při kontrole dodržování ustanovení GDPR.

Předávání Vašich osobních údajů do zahraničí

Vaše osobní údaje si předáváme pouze v rámci naši společnosti a nejsou předávány do zahraničí.

Jak dlouho Vaše osobní údaje uchováváme

Vaše osobní údaje uchováváme v závislosti na účelu, pro který jsme je získali. Vaše osobní údaje zpracováváme minimálně po dobu trvání smlouvy, a poté jsme nuceni uchovávat Vaše osobní údaje v souladu se skartačními lhůtami stanovenými zákonnými předpisy.

Zpracování cookies, sledování IP adres a jiné prostředky technologického sledování

Nepoužíváme žádné prostředky pro sledování, analyzování a vyhodnocování cookies, IP adres a jiných elektronických značek.

Profilování na základě osobních údajů

Neprovádíme profilování na základě poskytnutých osobních údajů.

Vaše práva

Společnost se hlásí k principům zavedeným nařízením Evropského parlamentu a Rady 2016/679 o ochraně fyzických osob v souvislosti se zpracováním osobních údajů a o volném pohybu těchto údajů (GDPR) a je připravena plně spolupracovat při výkonu Vašich práv.
Dle GDPR jsou Vaše práva:

• Právo subjektu OÚ na výmaz OÚ (právo být zapomenut), (článek 17 GDPR)
  Vaše osobní údaje budou vymazány s výjimkou údajů nezbytných pro plnění právní povinnosti, údajů nezbytných pro obhajobu právních nároků či údajů nezbytných pro ochranu veřejných zájmů.
• Právo subjektu OÚ být seznámen s údaji, které správce či zpracovatel o subjektu má (článek 15 GDPR)
  bude Vám poskytnuta kopie osobních údajů, které o Vás vedeme, s výjimkou našeho duševního vlastnictví nebo našeho obchodního tajemství, a dále pak případů, kdy by mohlo dojít k předání osobních údajů jiných osob.
• Právo subjektu OÚ vznést námitku proti zpracování osobních údajů (článek 21 GDPR)
  můžete kdykoliv vznést námitku, která bude projednána odpovídajícím způsobem tak, aby nedošlo k poškození Vašich zájmů. Námitku lze uplatnit v případech kdy je zpracování nezbytné pro účely oprávněných zájmů příslušného správce či třetí strany nebo proti zpracování osobních údajů pro účely přímého marketingu nebo profilování. Pokud vznesete námitku proti zpracování pro účely přímého marketingu, nebudou již Vaše osobní údaje pro tyto účely zpracovávány.
• Právo subjektu OÚ na omezení zpracování (článek 18 GDPR)
  na základě Vaší námitky dojde k omezení zpracování Vašich osobních údajů. Do vyřešení námitky je zpracování osobních údajů omezeno.
  Právo subjektu OÚ mít možnost přenést své osobní údaje od správce k třetímu subjektu (článek 20 GDPR)
  pokud jste nám poskytl(a) své osobní údaje na základě smlouvy nebo souhlasu budou Vám Vaše osobní údaje vyexportovány ve strukturovaném běžně používaném elektronickém formátu tak, abyste si je mohl(a) přenést k třetí straně.
• Právo subjektu OÚ žádat lidský přezkum v případě automatizovaného rozhodování (článek 22 GDPR)
  máte-li pochybnost o správnosti automatizovaného rozhodování na základě Vámi poskytnutých osobních údajů, zajistíme provedení rozhodnutí oprávněnou rolí.
  Právo subjektu OÚ na aktualizaci osobních údajů tak, aby mu jejich neaktuální verze nezpůsobila újmu (článek 16 GDPR)
  zajistíme aktualizaci Vašich osobních údajů na základě Vašeho podnětu.

Naše společnost Vás v souladu s článkem 21 odst. 4 GDPR zvlášť informuje, že máte právo namítat automatizované individuální rozhodování podle článku 21 GDPR a, že podle § 21 odst. 2 GDPR máte právo kdykoliv vznést námitku proti zpracovávání osobních údajů pro účely přímého marketingu (viz výše). V případě podezření, že Vaše osobní údaje jsou zpracovávány neoprávněně, máte právo podat u Úřadu na ochranu osobních údajů České republiky stížnost.

Organizační a technická opatření na ochranu osobních údajů

Naše společnost zajišťuje ochranu Vašich osobních údajů systémem řízení bezpečnosti, založeném na analýze rizik osobních údajů. Ubezpečujeme Vás, že neustále hodnotíme bezpečnostní situaci a rizika a upravujeme své plány bezpečnosti tak, aby nedošlo k ohrožení Vašich osobních údajů. Chceme Vás dále ujistit, že jsou implementovány odpovídající postupy a technologie pro zajištění informační, fyzické, personální i administrativní bezpečnosti, a to jak organizačními, tak technickými prostředky. Z pochopitelných důvodů neuvádíme tyto postupy a mechanismy na tomto místě.
